Welcome to the WildTangent License Agreement ("License"),which describes the terms and conditions which apply to your useof WildTangent software and related services and documentation("Software"). Please note that this License is a legally bindingagreement between you and WildTangent, Inc. ("WildTangent"), and byusing this Software, you agree to be bound by this License.If you do not agree with the License, please do not installthe Software or discontinue using the Software and uninstallit pursuant to the procedures identified below.

Also note that this License is subject to revision by WildTangentfrom time-to-time and that your continued use of the Software willbe subject to any such terms and conditions revisions. Accordingly,please review the License periodically (which is available onWildTangent's website athttp://www.wildtangent.com/eula)to ensure that you are familiar with any revisions and thatthey are acceptable to you.

1. Grant of Limited License.

Subject to the terms and conditions of this License, WildTangenthereby grants to you a non-exclusive, non-transferable, non-sublicenseable,personal and limited license solely to install and use the Software ona single computer to view or interact with content, such as artwork,pictures, text, video, audio, media files, programs, or applications,accessed by the Software including without limitation, any files ina WildTangent file format ("Content").

2. Restrictions on Limited License.

Please note that this License does not authorize you to use theSoftware or any Content in any manner other than as expresslyset forth in this License. You also specifically agree to not:

use the Software or any Content for any commercial purpose.
install or use any Content on more than one computer at a time.You may make one copy of the Content in machine-readable form forbackup purposes only. The backup copy must include all copyrightinformation contained on the original.
view any Content by any means other than by use of the Software.
decompile, reverse engineer, disassemble or otherwise deconstructthe Software, or any Content, except to the extent expressly mandatedby applicable law or authorized by WildTangent's prior written agreement.
modify, rent, lease, loan, sublicense, distribute, transmit,share (over a network or otherwise) or create derivative worksbased upon, the Software or any Content, or assign or otherwisetransfer your rights under this License, except pursuant to aWildTangent Distribution License Agreement executed by WildTangent.
disable, uninstall or otherwise impair the functionality of the Software,in whole or in part, except through implementation of the uninstallinstructions provided below.

3. Updates.

The Software makes use of your computer's most advanced hardwareaccelerated media capabilities, and as such its stability is vulnerableto changes in your computer's configuration such as operating systempatches, video driver changes, browser updates, etc. To ensure aconsistent and high quality experience, the Software will periodicallyprompt users to check online with WildTangent support databases forsoftware updates and patches. After installation, users may uninstallSoftware from the Windows Control Panel - Add/Remove Programs. WildTangent maychoose not to support Software that does not contain all availableupdates, in which case you may not be able to view all Content andSoftware functionality may be compromised. WildTangent may, but isnot required to provide you updates to the Software, and to theextent WildTangent does provide updates to the Software, the updatesand the updated Software will be subject to all the terms andconditions of this License, as revised from time-to-time, or anyadditional License accompanying the updates.

4. Title.

Title, ownership, rights, and intellectual property rights,including any patent rights, in and to the Software, will remainin WildTangent and its licensors or suppliers, and title, ownershiprights and intellectual property rights in and to the Content willbe retained by the applicable owner of the Content. WildTangentand its licensors and suppliers reserve all rights not expresslygranted to you, including without limitation copyright and otherintellectual property rights. WildTangent's licensors and suppliersare intended third party beneficiaries of this License and have theexpress right to rely upon and directly enforce its terms.

5. Warranty.

WildTangent warrants to you that the media or computer file thatcontains the Software or Content will be uncorrupted when youreceive it. If any portion of the Software, WildTangent Filesor Content is corrupted when you receive it, your exclusive remedy,and WildTangent's entire liability in contract, tort, orotherwise, will be to use commercially reasonable efforts toprovide uncorrupted media or an uncorrupted file to you or, inWildTangent's sole discretion, to reimburse you the amount paidby you to WildTangent for the Software.

Warranty Disclaimer. EXCEPT FOR THE EXPRESS REPRESENTATIONS AND WARRANTIESSTATED IN THIS SECTION 5, WILDTANGENT AND ITS PARTNERS, LICENSORS ANDSUPPLIERS MAKE NO ADDITIONAL REPRESENTATION OR WARRANTY OF ANY KINDWHETHER EXPRESS, IMPLIED (EITHER IN FACT OR BY OPERATION OF LAW), ORSTATUTORY. WILDTANGENT AND ITS PARTNERS, LICENSORS AND SUPPLIERS EXPRESSLYDISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR APARTICULAR PURPOSE, QUALITY, ACCURACY, TITLE, AND NON-INFRINGEMENT.WILDTANGENT AND IT PARTNERS, LICENSORS AND SUPPLIERS DO NOT WARRANTAGAINST INTERFERENCE WITH THE ENJOYMENT OF THE SOFTWARE, WILDTANGENTFILES OR CONTENT. WILDTANGENT AND ITS PARTNERS, LICENSORS AND SUPPLIERSDO NOT WARRANT THAT THE SOFTWARE, WILDTANGENT FILES OR CONTENT AREERROR-FREE OR THAT OPERATION OF THE SOFTWARE OR CONTENT WILL BE SECUREOR UNINTERRUPTED. YOU WILL NOT HAVE THE RIGHT TO MAKE OR PASS ON ANYREPRESENTATION OR WARRANTY ON BEHALF OF WILDTANGENT OR ITS PARTNERS,LICENSORS OR SUPPLIERS TO ANY THIRD PARTY.

6. Limitations of Liability.

Disclaimer of Consequential Damages.NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THIS AGREEMENT,WILDTANGENT AND ITS PARTNERS, LICENSORS AND SUPPLIERS WILL NOT, UNDERANY CIRCUMSTANCES, BE LIABLE TO YOU FOR CONSEQUENTIAL, INCIDENTAL,DIRECT, INDIRECT, SPECIAL, PUNITIVE OR OTHER DAMAGES ARISING OUT OFOR RELATED TO THE SOFTWARE, WILDTANGENT FILES OR CONTENT, INCLUDINGBUT NOT LIMITED TO LOST PROFITS OR LOSS OF BUSINESS, EVEN IF WILDTANGENTOR ITS PARTNERS, LICENSORS AND/OR SUPPLIERS HAVE BEEN APPRISED OF THEPOSSIBILITY OF SUCH DAMAGES OCCURRING. WILDTANGENT'S AND ITS PARTNERS',LICENSORS' AND SUPPLIERS' TOTAL LIABILITY ARISING OUT OF OR RELATED TOTHIS LICENSE (REGARDLESS OF WHETHER ANY ACTION OR CLAIM IS BASED ONCONTRACT, TORT OR OTHERWISE) SHALL NOT EXCEED THE TOTAL AMOUNT PAIDBY YOU TO WILDTANGENT FOR THE SOFTWARE AND CONTENT.

7. Termination.

Your rights under this License will terminate automatically ifyou fail to comply with any of the terms and conditions of thisLicense. No notice will be required from WildTangent to effectuatesuch termination. Upon termination, you must destroy all copiesof the Software.

8. Export Controls.

You are responsible for complying with all trade regulations andlaws both foreign and domestic. None of the Software or underlyinginformation or technology may be downloaded or otherwise exported orre-exported (i) into (or to a national or resident of) Cuba, Iran, Libya,North Korea, Sudan, Syria or any other country in violation of thelaws and administrative regulations of the United States or any otherapplicable jurisdiction; or (ii) to anyone on the U.S. TreasuryDepartment's List of Specially Designated Nationals or the U.S.Commerce Department's Table of Deny Orders. By downloading, installing,or using the Software, you are agreeing to the foregoing and youare representing and warranting that (i) you are not located in, underthe control of, acting on behalf of, or a national or resident of anysuch country or on any such list and (ii) you will not export orre-export the Software to any prohibited county, or to any prohibitedperson, entity, or end-user as specified by U.S. export controls.

9. Indemnification.

You agree to indemnify, defend and hold WildTangent and itsofficers, directors and employees harmless from and against anylosses, damages, fines and expenses (including attorneys' feesand costs) arising out of or relating to any claims that you haveviolated any term or condition of this License or have breachedany representation made by you in connection with the grant ofthis License. If you are importing the Software from the UnitedStates, you will indemnify and hold WildTangent harmless from andagainst any import and export duties or other claims arising fromsuch importation or exportation.

10. U.S. Government End Users.

The Software is a "commercial item," as that term is defined at48 C.F.R. 2.101 (Oct. 1995), consisting of "commercial computersoftware" and "commercial computer software documentation," as suchterms are used in 48 C.F.R. 12.212, and all U.S. Government EndUsers acquire the Software with only those rights set forth in this License.

11. Feedback.

Any comments or materials sent to WildTangent including feedback data,such as questions, comments, suggestions, or the like regarding theSoftware, Content or any other products or programs of WildTangent, orproposed products or programs (collectively "Feedback"), will be deemedto be non-confidential. WildTangent will have no obligation of anykind with respect to Feedback and will be free to reproduce, use,disclose, exhibit, display, transform, create derivative works, anddistribute the Feedback to others without limitation. Further, WildTangentwill be free to use any ideas, concepts, know-how or techniques containedin Feedback for any purpose, including but not limited to developing,manufacturing, and marketing products incorporating Feedback.

12. Privacy.

Our policies regarding personal and other information collection are available for review at:

WildTangent's Privacy Policies may be updated from time to time andby your election to use the Software you indicate your acceptance oftheir terms, as so revised, so please review the Policies carefullyand regularly check the WildTangent website to review updates.

13. Miscellaneous.

This License Agreement constitutes the complete and exclusive agreementbetween you and WildTangent, and supersedes any proposal or prior agreement,oral or written, and any other communications between us relating to thesubject matter of this License. Any rights not expressly granted in thisLicense are reserved. If any provision of this License is held to beunenforceable for any reason, the provision will be reformed only tothe extent necessary to make it enforceable, and the decision will notaffect the enforceability of the remaining provisions. This License willbe governed by the laws of the State of Washington, without regard toconflicts of law provisions, and you hereby consent to the exclusivejurisdiction of the state and federal courts sitting in King County,Washington, USA. Any and all unresolved disputes arising under this Licensewill be submitted to arbitration in King County, Washington, USA. Thearbitration will be conducted under the rules then prevailing ofJAMS/Endispute. The arbitrator's award will be binding and may be enteredas a judgment in any court of competent jurisdiction. You acknowledgethat a violation of this License may cause irreparable harm toWildTangent, and you agree that, in addition to any other remedies providedby law, WildTangent will be entitled to seek injunctive relief againstany such violation without having to post a bond. This License willnot be governed by the United Nations Convention of Contracts for theInternational Sale of Goods, the application of which is herebyexpressly excluded.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE, UNDERSTAND ITAND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. 1. Concesión de una licencia limitada.

Sujeto a las cláusulas y condiciones de esta Licencia, por la presente WildTangent le concede una licencia no exclusiva, no transferible, no sublicenciable, personal y limitada únicamente para instalar y usar el Software en un único equipo para ver o interactuar con el contenido, como obras de arte, imágenes, texto, video, audio, archivos de medios, programas o aplicaciones, a los que acceda el Software, entre ellos, los archivos en formato WildTangent ("Contenido").

2. Restricciones de la licencia limitada.

Tenga en cuenta que esta Licencia no le autoriza a usar el Software ni ningún Contenido en un modo distinto al que expresamente se detalla en la presente Licencia. Concretamente se compromete a no:

usar el Software o su Contenido con fines comerciales.
instalar o usar un Contenido en más de un equipo a la vez. Puede hacer sólo una copia del Contenido en un formato legible por el equipo a efectos de copia de seguridad. La copia de seguridad debe incluir toda la información de los derechos de propiedad contenida en el original.
ver ningún Contenido por otros medios que no sean el uso del Software.
decompilar, desarmar a la inversa, desmontar o deconstruir el Software, o un Contenido, salvo en la medida expresamente prevista por la ley vigente o autorizada por WildTangent mediante su acuerdo previo por escrito.
modificar, alquilar, arrendar, prestar, sublicenciar, distribuir, transmitir, compartir (en una red o de otra manera) o crear trabajos derivados basados en el Software o un Contenido, o asignar o transferir sus derechos bajo esta Licencia, salvo de conformidad con un Contrato de Licencia para la Distribución de WildTangent suscrito por WildTangent.
desactivar, desinstalar o impedir la funcionalidad del Software, en su totalidad o en parte, salvo mediante la implementación de las instrucciones de desinstalación que se proporcionan a continuación.

3. Actualizaciones.

El Software se sirve de la capacidad de aceleración de medios más avanzada de su equipo y, por tanto, su estabilidad puede verse afectada por los cambios en la configuración de su equipo, como parches del sistema operativo, cambios en el driver de video, actualizaciones del explorador, etc. Para garantizar la coherencia y la mayor calidad de esta experiencia, el Software solicitará regularmente a los usuarios que comprueben en línea la existencia en las bases de datos de ayuda de WildTangent de actualizaciones para el software y de parches. Tras la instalación, los usuarios podrán desinstalar el software desde el Panel de Control de Windows - Añadir/Quitar Programas. WildTangent puede decidir no proporcionar soporte para el Software que no contenga todas las actualizaciones disponibles, en cuyo caso usted no podría ver la totalidad del Contenido y la funcionalidad del Software podría quedar comprometida. Si una parte del Software, de los Archivos WildTangent o del Contenido está corrupta cuando los reciba, su única subsanación y la total responsabilidad de WildTangent en virtud del contrato, por el agravio, o como sea, será para realizar los esfuerzos comercialmente razonables para proporcionarle un medio o un archivo no corrupto o, a discreción de WildTangent exclusivamente, reembolsarle la cantidad pagada por usted a WildTangent por el Software.

WILDTANGENT Y SUS SOCIOS, LICENCIANTES Y PROVEEDORES NO OTORGAN NINGUNA GARANTÍA CONTRA LAS INTERFERENCIAS EN EL DISFRUTE DEL SOFTWARE, DE LOS ARCHIVOS WILDTANGENT O DEL CONTENIDO. WILDTANGENT Y SUS SOCIOS, LICENCIANTES Y PROVEEDORES NO OFRECEN GARANTÍA DE QUE EL SOFTWARE, LOS ARCHIVOS WILDTANGENT O EL CONTENIDO ESTÉN LIBRES DE ERRORES O QUE EL FUNCIONAMIENTO DEL SOFTWARE O EL CONTENIDO SEA SEGURO O DISCURRA SIN INTERRUPCIONES. NO OBSTANTE LO CONTRARIO CONTENIDO EN ESTE ACUERDO, WILDTANGENT Y SUS SOCIOS, LICENCIANTES Y PROVEEDORES NO TENDRÁN, BAJO NINGUNA CIRCUNSTANCIA, NINGUNA RESPONSABILIDAD ANTE USTED POR LOS DAÑOS EMERGENTES, SECUNDARIOS, DIRECTOS, INDIRECTOS, ESPECIALES, PUNITIVOS U OTROS QUE SE DERIVEN O ESTÉN RELACIONADOS CON EL SOFTWARE, LOS ARCHIVOS WILDTANGENT O EL CONTENIDO, ENTRE ELLOS, LA PÉRDIDA DE BENEFICIOS O LAS PÉRDIDA COMERCIALES, AUN CUANDO WILDTANGENT O SUS SOCIOS, LICENCIANTES Y/O PROVEEDORES HAYAN SIDO INFORMADOS DE LA POSIBILIDAD DE QUE DICHOS DAÑOS OCURRAN. LA RESPONSABILIDAD TOTAL DE WILDTANGENT Y SUS SOCIOS, LICENCIANTES Y PROVEEDORES QUE SE DERIVE O ESTÉ RELACIONADA CON ESTA LICENCIA (APARTE DE CUALQUIER ACCIÓN O RECLAMACIÓN BASADA EN EL CONTRATO, AGRAVIO U OTROS) NO DEBERÁ EXCEDER EL IMPORTE TOTAL PAGADO POR USTED A WILDTANGENT POR EL SOFTWARE Y EL CONTENIDO.

7. Rescisión.

Sus derechos en virtud de la presente Licencia quedarán rescindidos automáticamente si usted incumple una de las cláusulas y condiciones de la presente Licencia. No se requiere un aviso por parte de WildTangent para proceder a dicha rescisión. A la rescisión, usted deberá destruir todas las copias del Software.

8. Controles de Exportación.

Usted es el responsable del cumplimiento de todas las normativas y leyes tanto extranjeras como locales. Nada del Software o de la información o tecnología subyacente puede descargarse o exportarse o reexportarse bajo ningún concepto (i) a (o a un ciudadano o residente de) Cuba, Irán, Libia, Corea del Norte, Sudán, Siria u otro país que viole las leyes y normativas administrativas de los Estados Unidos o de cualquier otra jurisdicción aplicable; ni (ii) a nadie que figure en la Lista de Ciudadanos Especialmente Designados (List of Specially Designated Nationals) del Departamento del Tesoro o en la Tabla de Pedidos Denegados (Table of Deny Orders) del Departamento de Comercio estadounidense. 9. Indemnización.

Si importa el Software de Estados Unidos, deberá indemnizar y eximir a WildTangent de las tasas de importación y exportación u otras reclamaciones que se deriven de dicha importación o exportación.

10. Usuarios finales del gobierno de EE.UU.

13. Varios.

Los derechos no expresamente concedidos en la presente Licencia quedan reservados. Todas las disputas que se deriven de la presente Licencia serán sometidas al arbitraje en King County, Washington, EE.UU. El arbitraje se regirá por las normativas vigentes en aquel momento en JAMS/Endispute. El laudo arbitral será vinculante y tendrá la misma consideración que una sentencia judicial de un tribunal de jurisdicción competente. Benvenuti. Questo è l'Accordo di licenza WildTangent ("Licenza"), dove sono descritti i termini e le condizioni che regolano l'utilizzo da parte dell'utente del software WildTangent e dei relativi servizi e documenti ("Software"). Si informa che la presente Licenza istituisce un accordo legalmente vincolante tra l'utente e WildTangent, Inc. ("WildTangent") e che l'uso del Software costituisce accettazione integrale della Licenza. Se l'utente non approva la Licenza, non deve istallare il Software oppure ne deve sospendere l'uso e procedere alla disinstallazione seguendo le procedure di seguito descritte.

Si informa, inoltre, che la presente Licenza potrà essere periodicamente modificata da parte di WildTangent e che il successivo uso del Software sarà soggetto ai termini e alle condizioni così modificate. 1. Concessione di Licenza limitata

In conformità ai termini e alle condizioni della presente Licenza, WildTangent concede all'utente una licenza non esclusiva, non trasferibile, non riassegnabile a terzi, personale e limitata al solo e unico scopo di installare e usare il Software su un unico computer per visualizzare o interagire con contenuti come disegni, figure, testo, video, audio, file multimediali, programmi o applicazioni a cui il Software ha accesso, inclusi, a titolo esemplificativo ma non esaustivo, tutti i file in formato WildTangent ("Contenuto").

2. Restrizioni della Licenza limitata

La presente Licenza non autorizza l'utente a impiegare il Software o un qualsiasi Contenuto per usi diversi da quelli espressamente specificati in essa. Inoltre, l'utente si impegna specificamente a non compiere i seguenti atti:

Usare il Software o un qualsiasi Contenuto per scopi commerciali.
Installare o usare qualsiasi Contenuto su più computer contemporaneamente. L'utente può fare una copia del Contenuto in formato elettronico al solo scopo di effettuare un backup. La copia di backup deve essere corredata di tutte le informazioni sul copyright contenute nell'originale.
Visualizzare il Contenuto con modalità diverse dall'uso del Software.
Decompilare, sottoporre a reverse engineering, scomporre o altrimenti decostruire il Software o qualsiasi Contenuto, tranne che nella misura espressamente richiesta dalle leggi applicabili o autorizzata da WildTangent previo consenso scritto.
Modificare, noleggiare, dare in locazione, dare in prestito, concedere in sublicenza, distribuire, trasmettere, condividere (tramite una rete o altrimenti), creare nuove versioni basate sul Software o sul Contenuto o cedere o trasferire in altro modo i diritti dell'utente previsti dalla presente Licenza, tranne che per quanto previsto dall'Accordo di licenza per la distribuzione di WildTangent sottoscritto da quest'ultimo.
Disabilitare, disinstallare o compromettere in altro modo la funzionalità del Software, in tutto o in parte, tranne che mettendo in atto le istruzioni di disinstallazione fornite di seguito.

3. Aggiornamenti

Il Software usa le più avanzate funzionalità multimediali di accelerazione hardware del computer dove è installato, e pertanto la sua stabilità è vulnerabile ai cambiamenti di configurazione, quali patch del sistema operativo, modifiche dei driver video, aggiornamenti del browser ecc. Al fine di garantire una fruizione regolare e di alta qualità, verrà periodicamente consigliato agli utenti di controllare online, tramite i database di supporto di WildTangent, se vi sono aggiornamenti o patch disponibili. Dopo l'installazione, gli utenti potranno disinstallare il Software da Pannello di controllo > Installazione applicazioni. WildTangent potrà scegliere di non supportare i Software che non contengono tutti gli aggiornamenti disponibili. In tal caso l'utente potrebbe non riuscire a visualizzare tutto il Contenuto e la funzionalità del Software potrebbe essere compromessa. WildTangent può rendere disponibili agli utenti gli aggiornamenti per il Software, ma non è tenuta a farlo e, nella misura in cui fornisca tali aggiornamenti, questi ultimi e il Software aggiornato sono soggetti a tutti i termini e condizioni della presente Licenza, incluse relative modifiche periodiche, o di qualsiasi altra Licenza associata agli aggiornamenti.

4. Titolo di proprietà

Titolo di proprietà, diritti di possesso e di proprietà intellettuale, inclusi quelli relativi a brevetti e al Software, saranno detenuti da WildTangent e dai suoi licenzianti e fornitori, mentre titolo di proprietà, diritti di possesso e di proprietà intellettuale relativi al Contenuto saranno detenuti dal proprietario pertinente. WildTangent e i suoi licenzianti e fornitori si riservano tutti i diritti non espressamente concessi all'utente, inclusi, a titolo esemplificativo ma non esaustivo, i diritti di copyright e altri diritti di proprietà intellettuale. I licenzianti e i fornitori di WildTangent sono terzi beneficiari designati della presente Licenza e hanno esplicitamente il diritto di appellarsi ai suoi termini e dare loro diretta esecuzione.

5. Garanzia

WildTangent garantisce all'utente che il file multimediale o informatico recante il Software o il Contenuto sarà integro al momento della ricezione. Se qualsiasi parte del Software, dei File WildTangent o del Contenuto fosse danneggiata al momento della ricezione da parte dell'utente, l'unico rimedio possibile, nonché totale responsabilità di WildTangent in contratto, per illecito o altrimenti, consisterà nel compiere qualsiasi sforzo commercialmente ragionevole per fornire all'utente un file multimediale o informatico non danneggiato oppure, a completa discrezione di WildTangent, rimborsare all'utente la somma versata per il Software.

Esclusione di garanzia. AD ECCEZIONE DELLE DICHIARAZIONI E DELLE GARANZIE ESPLICITAMENTE MENZIONATE NELLA PRESENTE SEZIONE 5, WILDTANGENT E I SUOI PARTNER, LICENZIANTI E FORNITORI NON AMMETTONO ALCUNA ULTERIORE DICHIARAZIONE O GARANZIA DI ALCUN TIPO, ESPLICITA, IMPLICITA (SIA DI FATTO CHE PER LEGGE) O STATUTARIA. 6. Limitazioni di responsabilità

Esclusione di responsabilità per danni conseguenti. FATTA SALVA QUALSIASI DISPOSIZIONE CONTRARIA CONTENUTA NEL PRESENTE ACCORDO, WILDTANGENT E I SUOI PARTNER, LICENZIANTI E FORNITORI NON SARANNO IN NESSUN CASO RESPONSABILI NEI CONFRONTI DELL'UTENTE PER EVENTUALI DANNI CONSEGUENTI, ACCIDENTALI, DIRETTI, INDIRETTI, PARTICOLARI, PUNITIVI O DI ALTRA NATURA RELATIVI O DERIVANTI DALL'USO DEL SOFTWARE, DEI FILE WILDTANGENT O DEL CONTENUTO, INCLUSE, A TITOLO ESEMPLIFICATIVO MA NON ESAUSTIVO, PERDITE DI PROFITTO O DI ESERCIZIO, ANCHE NEL CASO IN CUI WILDTANGENT O I SUOI PARTNER, LICENZIANTI E/O FORNITORI FOSSERO STATI AL CORRENTE DEL POSSIBILE INSORGERE DI TALI DANNI. LA RESPONSABILITÀ COMPLESSIVA DI WILDTANGENT E DEI SUOI PARTNER, LICENZIANTI E FORNITORI RELATIVA O DERIVANTE DALLA PRESENTE LICENZA (INDIPENDENTEMENTE DAL FATTO CHE QUALSIASI AZIONE O RIVENDICAZIONE SIA BASATA SU CONTRATTO, ILLECITO O ALTRIMENTI) NON DOVRÀ SUPERARE LA SOMMA TOTALE VERSATA DALL'UTENTE A WILDTANGENT PER IL SOFTWARE E IL CONTENUTO.

7. Rescissione

I diritti dell'utente ai sensi della presente Licenza decadranno automaticamente qualora l'utente non osservi qualunque termine o condizione qui contenuti. WildTangent non sarà tenuta a inviare alcuna comunicazione per dare seguito a tale rescissione. In caso di rescissione, l'utente dovrà distruggere tutte le copie del Software.

8. Controlli sull'esportazione

È responsabilità dell'utente conformarsi a tutti i regolamenti e leggi commerciali, sia nazionali che esteri. Nessuna parte del Software o delle informazioni o tecnologie connesse potrà essere scaricata o altrimenti esportata o riesportata (i) nel territorio o a favore di cittadini o residenti di Cuba, Iran, Libia, Corea del Nord, Sudan, Siria o qualsiasi altro paese in violazione delle leggi e delle disposizioni amministrative degli Stati Uniti o di qualsiasi altra giurisdizione competente; oppure (ii) a favore di chiunque compaia nell'elenco di persone segnalate del Dipartimento del Tesoro degli Stati Uniti (List of Specially Designated Nationals) o del Dipartimento del Commercio degli Stati Uniti (Table of Deny Orders). Scaricando, installando o utilizzando il Software, l'utente approva quanto detto sopra e dichiara e garantisce (i) di non trovarsi fisicamente o sotto il controllo di alcuno di tali paesi, di non agire per suo conto, di non esserne un cittadino o un residente e di non appartenere ad alcuna di tali liste e (ii) di non esportare o riesportare il Software in alcun paese proibito o in favore di alcun individuo, entità o utente finale per il quale esista una proibizione secondo quanto specificato dai controlli sull'esportazione degli Stati Uniti.

9. Indennità

L'utente accetta di indennizzare, difendere e preservare WildTangent e i suoi funzionari, direttori e dipendenti da e contro tutte le perdite, danni, multe e spese (comprese le spese legali) relativi o derivanti da qualsiasi supposta violazione da parte dell'utente di qualsiasi termine o condizione della presente Licenza o inosservanza di qualsiasi dichiarazione rilasciata dall'utente in relazione alla concessione della presente Licenza. Se l'utente importa il Software dagli Stati Uniti, dovrà indennizzare e preservare WildTangent da e contro qualsiasi dazio di importazione o esportazione o altra richiesta derivante da tale importazione o esportazione.

10. Utilizzatori finali del Governo degli Stati Uniti

Il Software è un "prodotto commerciale", secondo quanto definito nell'articolo 48 C.F.R. 2.101 (Ottobre 2005), costituito da "software per computer disponibile in commercio" e "documentazione relativa a software per computer disponibile in commercio", secondo quanto definito nell'articolo 48 C.F.R. 12.212, e tutti gli utenti finali appartenenti al governo degli Stati Uniti acquisiscono il Software con i soli diritti stabiliti nella presente Licenza.

11. Feedback

Qualsiasi commento o altro materiale inviato a WildTangent, incluse le informazioni di feedback, come domande, commenti, suggerimenti o simili relativi al Software, al Contenuto o ad altri prodotti o programmi di WildTangent, o prodotti o programmi proposti (congiuntamente "Feedback") saranno trattati come dati non riservati. WildTangent non avrà alcun obbligo nei confronti del Feedback e sarà libera di riprodurre, utilizzare, divulgare, esibire, mostrare, trasformare, creare nuove versioni e distribuire il Feedback ad altri senza alcuna limitazione. Inoltre, WildTangent sarà libera di utilizzare qualsiasi idea, concetto, know-how o tecnica contenuti nel Feedback per qualsiasi scopo, inclusi, a titolo esemplificativo ma non esaustivo, lo sviluppo, la produzione e il marketing di prodotti che incorporano il Feedback.

13. Varie

Il presente Accordo di licenza costituisce completo ed esclusivo accordo fra l'utente e WildTangent e sostituisce qualsiasi proposta o accordo precedente, in forma orale o scritta, e qualsiasi altra comunicazione intercorsa fra le parti in relazione al contenuto di questa Licenza. Tutti i diritti non espressamente concessi con la presente Licenza sono riservati. Qualora una delle disposizioni della presente Licenza fosse ritenuta inapplicabile per qualsiasi motivo, tale disposizione sarà modificata solo nella misura necessaria a renderla applicabile e la decisione in merito non pregiudicherà l'applicabilità delle altre disposizioni. La presente Licenza sarà disciplinata secondo la legislazione dello stato di Washington e indipendentemente da conflitti con disposizioni di legge. L'utente quivi accetta come giurisdizione esclusiva quella dei tribunali statali e federali competenti a King County, Washington, USA. Ogni e qualsivoglia controversia risultante dalla presente Licenza sarà sottoposta ad arbitrato a King County, Washington, USA. L'arbitrato sarà condotto secondo le norme al momento in vigore dell'ente di risoluzione delle controversie JAMS/Endispute. Il lodo arbitrale sarà vincolante e potrà essere presentato in qualità di sentenza presso qualsiasi tribunale competente per giurisdizione. L'utente riconosce che una violazione della presente Licenza potrebbe arrecare danno irreparabile a WildTangent e conviene altresì che sia concesso a WildTangent, insieme a qualsiasi altro rimedio previsto dalla legge, il diritto di ricorrere a procedimento ingiuntivo contro tale violazione senza necessità di fideiussione. La presente Licenza non sarà invece disciplinata dalla Convenzione delle Nazioni Unite sui contratti di vendita internazionale di beni mobili, la cui applicazione viene espressamente esclusa.

Si informa che la versione in lingua inglese della presente Licenza è il documento ufficiale di riferimento e, accettando di scaricare i prodotti di WildTangent, l'utente accetta i termini della Licenza in lingua inglese. 1. Octroi d'une Licence limitée.

Conformément aux termes et conditions de cette Licence, WildTangent vous octroie une licence non exclusive, non transférable, non sous-licenciable, personnelle et limitée uniquement pour installer et utiliser le Logiciel sur un seul ordinateur afin de visualiser ou interagir avec du contenu, tel que des illustrations, des images, des fichiers texte, vidéo, audio, multimédia, des programmes ou applications, auxquels le Logiciel a accès, y compris, sans limitation, tous les fichiers au format WildTangent (« Contenu »).

2. Restrictions de la Licence limitée.

Veuillez noter que cette Licence ne vous autorise pas à utiliser ce Logiciel ou tout autre Contenu d'une façon différente de celle expressément stipulée dans cette Licence. Vous acceptez également spécifiquement de ne pas :

Utiliser le Logiciel ou tout Contenu à des fins commerciales.
Installer ou utiliser tout Contenu sur plus d'un seul ordinateur à la fois. Vous êtes autorisé à effectuer une copie du Contenu en une forme lisible par les ordinateurs à des fins de sauvegarde uniquement. La copie de sauvegarde doit inclure toutes les informations de copyright comprises dans la version originale.
Visualiser tout Contenu autrement que via le Logiciel.

Désactiver, désinstaller ou altérer d'une autre manière la fonctionnalité du Logiciel, dans son ensemble ou en partie, sauf via la mise en œuvre des instructions de désinstallation fournies ci-dessous.

3. Mises à jour.

Le Logiciel utilise les capacités les plus avancées de média accéléré par le matériel de votre ordinateur. Dès lors, sa stabilité est sensible aux changements apportés à la configuration de votre ordinateur, tels que les correctifs de système d'exploitation, les modifications de pilote vidéo, les mises à jours de navigateur, etc. Afin de vous assurer une utilisation compatible et de haute qualité, le Logiciel proposera régulièrement aux utilisateurs de rechercher en ligne des mises à jour logicielles et des correctifs dans les bases de données d'assistance de WildTangent. Une fois l'installation terminée, les utilisateurs peuvent désinstaller le Logiciel à partir de l’application Ajout/Suppression de programmes dans le Panneau de configuration Windows. Il se peut que WildTangent décide de ne pas prendre en charge un Logiciel ne contenant pas toutes les mises à jours disponibles, auquel cas vous ne pourrez peut-être pas visualiser tout le contenu et la fonctionnalité du Logiciel pourrait être compromise. WildTangent peut, mais n'est pas tenu de vous fournir les mises à jour du Logiciel et, dans la mesure où WildTangent vous fournit les mises à jour du Logiciel, les mises à jour ainsi que le Logiciel mis à jour seront sujets à toutes les conditions générales de cette Licence, telle que revues de façon ponctuelle, ou à toute licence supplémentaire accompagnant les mises à jour.

4. Titre.

Le titre de propriété, le droit de propriété, les droits et droits de propriété intellectuelle, y compris tout droit de brevet relatif au Logiciel restent la propriété de WildTangent et de ses concédants de Licence ou fournisseurs. Le titre de propriété, le droit de propriété, les droits et droits de propriété intellectuelle relatifs au Contenu resteront la propriété du propriétaire du contenu. 7. Résiliation.

Vos droits découlant de cette Licence prendront automatiquement fin si vous ne vous conformez pas à l'un des termes et conditions de cette Licence. Aucune notification de la part de WildTangent ne sera requise pour que cette résiliation soit effectuée. Une fois la résiliation effectuée, vous êtes tenu de détruire tous les exemplaires du Logiciel.

8. Contrôles d'exportation.

Vous êtes tenu de vous conformer à toutes les réglementations et législations commerciales tant étrangères que nationales. 2. Einschränkungen der beschränkten Lizenz.

Bitte beachten Sie, dass Sie durch diese Lizenz dazu befugt sind, die Software und den Content ausschließlich auf die in dieser Lizenz ausdrücklich beschriebenen Weise zu verwenden. Insbesondere erklären Sie sich mit Folgendem einverstanden:

Die Software oder den Content nicht zu gewerblichen Zwecken zu verwenden.
Den Content nicht auf mehr als einem Computer auf einmal zu installieren bzw. zu verwenden. Zu Sicherungszwecken dürfen Sie eine einzelne Kopie des Content in einem maschinenlesbaren Format erstellen. Die Sicherungskopie muss alle Urheberrechtsangaben des Originals beinhalten.
Den Content nicht auf andere Weise als mithilfe der Software anzuzeigen.
Die Software bzw. den Content nicht zu dekompilieren, zurückzuentwickeln, auseinander zu nehmen oder anderweitig zu zerlegen, außer soweit ausdrücklich vom geltenden Recht angeordnet oder durch ein vorheriges schriftliches Einverständnis von WildTangent genehmigt.
Die Software bzw. den Content nicht zu ändern, zu vermieten, zu verpackten, auszuleihen, zu unterlizenzieren, zu vertreiben, zu übertragen, freizugeben (über ein Netzwerk oder anderweitig) oder davon abgeleitete Erzeugnisse zu erstellen, oder Ihre Rechte unter dieser Lizenz abzutreten oder anderweitig zu übertragen, außer gemäß eines von WildTangent ausgefertigten WildTangent-Vertriebspartnervertrags.

1. 제한된 라이센스 부여

3. 업데이트

이 소프트웨어는 사용되는 컴퓨터의 가장 향상된 하드웨어로 가속화된 미디어 기능을 이용하며 따라서 운영 체제, 패치, 비디오 드라이버 변경, 브라우저 업데이트 등과 같은 컴퓨터 구성 변경 시 안정성이 손상될 수 있습니다. 일관된 높은 수준의 게임 환경을 확보하기 위해 소프트웨어는 소프트웨어 업데이트와 패치를 WildTangent 지원 데이터베이스를 이용하여 온라인으로 점검하라는 메시지를 정기적으로 표시합니다. 설치 후 사용자들은 Windows 제어판 - 프로그램 추가/제거에서 소프트웨어를 설치 제거할 수 있습니다. WildTangent는 사용 가능한 모든 업데이트가 포함되지 않은 소프트웨어는 지원하지 않을 수 있으며 이 경우 모든 콘텐츠가 보이지 않을 수도 있고 소프트웨어 기능이 손상될 수 있습니다. WildTangent는 귀하에게 소프트웨어에 대한 업데이트를 제공할 수 있으나 그렇게 해야 할 의무는 없습니다. WildTangent와 WildTangent의 라이센스 허여자 또는 공급업체는 본 라이센스에 대한 본래의 제 3자 수혜자이며 사용 약관에 의존하고 직접 실행할 수 있는 명시적인 권리를 보유합니다.

5. 보증

3. 更新。

4. 标题。

5. 担保。

7. 终止。

10. 美國政府最終使用者。

本軟體屬於 48 C.F.R. 2.101（1995 年 10 月）所定義之「商品」(commercial item)，包含 48 C.F.R. 12.212 中定義的「商業電腦軟體」(commercial computer software) 和「商業電腦軟體文件」(commercial computer software documentation)，且所有美國政府最終使用者獲得本軟體將僅隨附本授權中規定的那些權利。

11. 回饋。

發送給 WildTangent 的任何意見或內容，包括回饋資料，例如關於本軟體、內容或 WildTangent 任何其他產品或程式、或擬議產品或程式的問題、評論、建議或此類資訊（統稱「回饋」），均將被視為非保密資訊。WildTangent 對回饋不承擔任何類型的義務，並可毫無限制地自由複製、使用、揭露、展示、顯示、傳送、建立衍生作品以及向他人發佈。此外，WildTangent 將可自由地出於任何目的使用回饋中所含之任何構思、概念、竅門或技術，包括但不限於開發、製造及行銷包含回饋建議的產品。

13. 其他規定。
